It varies.

Read your contract. The details are there. (You DID keep your copy of the contract that you signed when you bought your car, right?)

Once a loan is charged off it cannot be un-charged off... the only option is to pay off the amount due with a loan you obtain from somewhere else. If your credit is wrecked because of this charge-off you may have a problem, since no other finance company is going to want to give you an auto loan to pay off one which you failed to pay for whatever reason. They are lying when they said they spoke to your mother-in-law; she certainly would have told you... or maybe she did, but you forgot. It might be possible to try to explain that the failure to pay was not your fault and that you thought the payments had been made automatically, but with banks these days delighting in screwing people over you may be facing an uphill battle. For the time being, hide the car. If it's parked on the street you will get up one morning and it will be gone. Finance companies steal these things back as a matter of course. Your only option may be to rty to obtain a new car loan elsewhere.

This is in the statement I received every month:

"A late charge of $ 10.00 will be assessed if your payment is not received by 8/01/2009".

Which is 2 weeks after my payment due date.
